The Rules of the Road

These are the terms that govern your use of sleepingorganic.com and any orders you place with us. We have written them in plain English so you know exactly what you are agreeing to when you shop with our family.

Sleeping Organic (“we,” “us,” or “our”) is a family owned mattress company based in North Charleston, South Carolina. We operate sleepingorganic.com and sell handcrafted natural latex mattresses, toppers, pillows, adjustable beds, and bedding directly to customers across the United States.

These Terms and Conditions form a legal agreement between you and Sleeping Organic. By browsing our website, creating an account, signing up for our emails or texts, or placing an order, you agree to be bound by these terms. If you do not agree with any part of them, please do not use the site or place an order.

Eligibility

To place an order or open an account on sleepingorganic.com, you must be at least 18 years old and able to enter into a legally binding contract in the state where you live.

We currently sell and ship only within the United States.

  • Free ground shipping is offered to addresses in the 48 contiguous United States.
  • We do not currently ship to Alaska, Hawaii, US territories, APO/FPO addresses, or freight forwarders.
  • We do not ship internationally at this time.
  • Mattresses, foundations, adjustable beds, and other oversize items cannot be delivered to PO boxes, APO/FPO addresses, or freight forwarders.

If you place an order with an ineligible address, we will contact you to update it or, if needed, cancel and refund the order in full.

Accounts and Order Placement

You can check out as a guest or create an account. When you give us account or order information, you agree to provide details that are accurate, current, and complete, and to keep them updated as needed. You are responsible for keeping your account password confidential and for activity that takes place under your account.

When you submit an order through our site, you are making an offer to buy the products in your cart at the prices and on the terms shown. Your order is not accepted until we send a separate confirmation email and your payment is captured. We may decline or cancel an order, in whole or in part, in cases that include:

  • Suspected fraud or unauthorized use of a payment method.
  • Stock shortages or production constraints on custom built items.
  • Obvious pricing or typographical errors.
  • Shipping addresses we cannot serve, such as PO boxes for oversize items.
  • Prior account history that suggests the order is not in good faith.

If we cancel an order before it ships, we will refund any amount charged to your original payment method.

Pricing and Payment

All prices on sleepingorganic.com are listed in US dollars. Sales tax is calculated at checkout for orders shipping to states where we are required to collect it.

We accept the following payment methods through our secure payment partners:

  • Visa, Mastercard, American Express, and Discover credit and debit cards.
  • PayPal.
  • Affirm financing for qualified buyers, where eligible at checkout.
  • Apple Pay, where supported by your device and browser.

You authorize us, or our payment processor, to charge the payment method you select for the full order total, including any applicable taxes and shipping fees.

We work hard to keep pricing accurate, but errors do occur. If a product is listed at an obviously incorrect price, we reserve the right to cancel the affected order and issue a full refund, even after a confirmation email has been sent. We will contact you before doing so whenever possible.

Promotional pricing, sale events, and discount codes are valid only during the dates and on the terms shown on the site. Some promotions may exclude certain products or be limited to one use per household. Sale prices end at the date and time stated and are not retroactive.

Shipping and Delivery

We offer free ground shipping on orders to the 48 contiguous United States. Most products ship from our workshop or our suppliers in Charleston, South Carolina.

  • Mattresses, toppers, foundations, and other large items typically take 4 to 7 business days to ship after your order is placed.
  • Pillows, sheets, and small accessories usually ship within 1 to 3 business days.
  • Adjustable beds may take 5 to 10 business days to leave our warehouse.
  • You will receive a tracking link by email once a label is created.

Shipping windows are estimates, not guarantees. Once a package leaves our facility, transit times depend on the carrier. Weather, holidays, and carrier delays may extend delivery dates. Risk of loss for delivered items passes to you when the carrier confirms delivery to the address you provided.

Some freight or oversize shipments require an adult signature on delivery. If a package is marked delivered but you cannot find it, please contact us within 48 hours so we can open a trace with the carrier and work with you on next steps. We are not responsible for items that are stolen after a confirmed delivery, but we will help you file a carrier claim and we always do what we can to make things right.

Returns

Because of the personal and sanitary nature of bedding, some products are final sale and cannot be returned once they ship. Final sale items include:

  • All pillows, including latex, kapok, wool, and body pillows.
  • Loose kapok fill and other loose fiber products.
  • Opened bags of shredded latex.
  • Any other consumable, sanitary, or made to order item identified as final sale at checkout.

For mattresses, toppers, foundations, adjustable beds, and bedding, our specific return windows, restocking fees, and return shipping arrangements are described on our Shipping and Returns page. Please review that page before you order.

Mattresses are not eligible for a traditional money back return after the first night of use. Instead, we support new mattress owners through our 365-Day Comfort Program, described below, which lets you adjust your mattress to dial in the right feel.

Defective items are handled separately under our warranty, also described below.

365-Day Comfort Program

Every Sleeping Organic mattress is built layer by layer, which means we can adjust it after delivery. The 365-Day Comfort Program lets you swap a single latex layer or change a firmness level within 365 days of your original mattress purchase, so you can fine tune your bed to fit your body and sleep style.

  • Available on new mattresses purchased directly from sleepingorganic.com.
  • Covers one layer exchange or firmness adjustment per mattress.
  • The customer is responsible for return shipping of the original layer in its original packaging, and we cover outbound shipping of the replacement.
  • The program is a layer exchange and adjustment service, not a money back return or refund.

Product Warranty

Sleeping Organic stands behind the products we make. Our limited warranty covers defects in materials and workmanship under normal residential use, by the original purchaser who bought the product directly from us.

  • Natural latex mattresses. 20 year limited warranty against manufacturing defects, with a prorated structure described in detail on our warranty page.
  • Pillows and toppers. 5 year limited warranty against defects in materials and workmanship.
  • Adjustable bed bases. Manufacturer limited warranties of 1 year on parts and labor, with extended coverage on motors and frames as described by the manufacturer.
  • Bedding, sheets, and accessories. Covered against defects for the period stated on the product page or invoice.

The warranty does not cover normal wear and softening of natural materials, comfort preference, damage from improper foundations or unsuitable surfaces, stains, burns, abuse, commercial use, or items purchased through unauthorized resellers.

Intellectual Property

All content on sleepingorganic.com, including text, photographs, illustrations, video, audio, logos, product designs, page layouts, and the underlying code, is owned by Sleeping Organic or licensed to us. It is protected by US copyright, trademark, and other intellectual property laws.

You may view, share links to, and print individual pages for personal, non commercial use. Beyond that, you may not:

  • Copy, reproduce, or republish our content on another website, app, or marketplace.
  • Use our photos, descriptions, or product specs for a competing product or listing.
  • Scrape, crawl, or systematically download content from the site.
  • Remove or alter any copyright, trademark, or attribution notice.
  • Use the Sleeping Organic name, logo, or marks in any way that suggests affiliation, sponsorship, or endorsement we have not granted in writing.

Acceptable Use

When you use sleepingorganic.com, you agree not to:

  • Attempt to gain unauthorized access to any account, server, or system.
  • Reverse engineer, decompile, or otherwise probe the site for vulnerabilities.
  • Use bots, scripts, scrapers, or other automated means to access the site or place orders without our written permission.
  • Submit false or misleading information at checkout, in account fields, or in customer service requests.
  • Submit fake, paid, or fraudulent product reviews, or reviews from anyone with an undisclosed financial interest in the product.
  • Upload or transmit viruses, malware, or any code that could harm our systems or other users.
  • Use the site to harass, threaten, or defame Sleeping Organic, our staff, or other customers.
  • Use the site for any unlawful purpose or in violation of any federal, state, or local law.

We may suspend or close accounts, cancel orders, or take other action when we reasonably believe these rules have been broken.

Reviews and User Submissions

We love hearing from customers. When you post a product review, share a photo of your setup, send us a testimonial, or otherwise submit content to us through the website, email, social media, or a review platform we use, you grant Sleeping Organic a non exclusive, royalty free, worldwide, perpetual license to use, reproduce, adapt, publish, and display that content in connection with our products and marketing, with attribution where reasonable.

By submitting a review or other content, you confirm that:

  • The content is your own and does not violate anyone else’s rights.
  • You actually purchased and used the product, if the review is presented as a verified purchase.
  • You have not been paid or given a free product in exchange for a positive review, unless that arrangement is clearly disclosed.

We may edit reviews lightly for clarity, length, profanity, or personal information, and we may decline to publish reviews that are off topic, defamatory, or violate these terms. We do not edit reviews to change their substance or rating.

SMS and Text Messaging

If you opt in to text messages from Sleeping Organic, you agree to the SMS terms described in our Privacy Policy. In short, message frequency varies, message and data rates may apply, and you can stop messages at any time by replying STOP or get help by replying HELP. Consent to receive marketing texts is never a condition of purchase.

Disclaimers

We work hard to provide accurate product information, and we believe deeply in the products we make. That said, sleepingorganic.com and the products and services available through it are provided on an “as is” and “as available” basis, without warranties of any kind beyond those expressly stated in these terms or our written product warranty.

To the fullest extent allowed by law, we disclaim all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non infringement. We do not warrant that the site will be uninterrupted, error free, or free of harmful components.

Our mattresses and bedding are home goods, not medical devices. They are not intended to diagnose, treat, cure, or prevent any medical condition. If you have a medical concern about pain, allergies, or sleep, please consult a qualified healthcare professional.

Limitation of Liability

To the fullest extent permitted by South Carolina law, Sleeping Organic, our owners, employees, suppliers, and partners are not liable for indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the site or any product purchased through it. This includes lost profits, lost data, lost sleep time, and damages for inconvenience, even if we have been advised of the possibility of such damages.

Our total cumulative liability for any claim related to a product or order is limited to the amount you actually paid for that product or order. Some states do not allow the exclusion or limitation of certain damages, so portions of this section may not apply to you. Nothing in these terms limits any rights you have under applicable consumer protection law that cannot be waived by agreement.

Indemnification

You agree to indemnify and hold harmless Sleeping Organic, our owners, employees, and authorized representatives, from any third party claims, losses, liabilities, damages, costs, and reasonable attorneys’ fees arising out of:

  • Your misuse of the website or any product purchased through it.
  • Your violation of these Terms and Conditions.
  • Your violation of any law or the rights of a third party in connection with your use of our site or products.
  • Content you submit, including reviews, photos, or testimonials.

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense.

Governing Law and Disputes

These Terms and Conditions, and any dispute arising out of or related to them or to your use of sleepingorganic.com, are governed by the laws of the State of South Carolina, without regard to its conflict of laws principles.

Before filing any formal action, you agree to first contact us in writing and give us a reasonable opportunity to resolve the issue informally. Most disputes can be sorted out by phone or email. You can reach us at (800) 625-4042 or [email protected].

If a dispute cannot be resolved informally, the exclusive venue for any state or federal court action will be Charleston County, South Carolina, and you and Sleeping Organic each consent to the personal jurisdiction of those courts. Either party may also bring a qualifying claim in small claims court in the county where the customer resides.

Any claim must be filed within one year after the cause of action arose, or within the shortest period otherwise allowed by South Carolina law, whichever is longer.

Changes to These Terms

We may update these Terms and Conditions from time to time as our business, our products, or applicable laws change. When we do, we will revise the “Last Updated” date at the top of the page. If the changes are material, such as a change in dispute resolution or in the scope of these terms, we will provide additional notice. For example, we may notify you by email if you have subscribed to our list, or by a banner on the site for a reasonable period.

Your continued use of the site or placement of a new order after an update takes effect means you accept the revised terms. If you do not agree with an update, please stop using the site and contact us with any questions.

Severability and Entire Agreement

If any portion of these Terms and Conditions is found to be unenforceable by a court of competent jurisdiction, the remaining provisions will stay in full force and effect. The unenforceable portion will be modified to the minimum extent necessary to make it enforceable while preserving the original intent.

These Terms and Conditions, together with our Privacy Policy, the policies linked from our checkout, and any written warranty or order confirmation, are the entire agreement between you and Sleeping Organic with respect to your use of the site and the products you buy from us. They replace any prior agreements or understandings on these topics.

Our failure to enforce a particular provision is not a waiver of our right to enforce it later.
